STAMPIX PHOTO CONTEST - TERMS AND CONDITIONS

Article 1 — Organiser This contest ("the Contest") is organised by Stampix BV, with registered office at Geo Verbancklaan 11, 9051 Sint-Denijs-Westrem, Oost-Vlaanderen, Belgium, registered under company number BE 0651.901.465 ("the Organiser", "we", "us"). The main prize of this Contest is provided by Sunweb (hereinafter "the Sponsor"). The Sponsor is not a party to these contest terms and is not responsible for the organisation, entry conditions, or content of the Contest. By participating in the Contest ("Participant(s)") or by voting on an entry ("Voter(s)"), you fully and unconditionally accept these contest terms ("the Terms"). Article 2 — Contest Period The Contest runs from 15/09/2026 at 19:00 to 06/10/2026 at 23:59 (CET/CEST) ("the Contest Period"). Entries submitted after the end date of the Contest Period will not be considered. Votes registered or confirmed after the end date will no longer count towards the final ranking. The Organiser reserves the right to extend or shorten the Contest Period in accordance with Article 12. Article 3 — Who May Participate 3.1. Participation is open to any natural person who: is at least 18 years old at the time of participation; resides in Belgium, the Netherlands, or Luxembourg (Benelux); can verify a valid email address. 3.2. Excluded from participation are: employees of the Organiser and of the Sponsor, their immediate family members (cohabiting partner, children, parents), and anyone professionally involved in organising this Contest. 3.3. A maximum of one (1) valid entry per person is allowed. In the event of multiple entries by the same person (same name, email address, photo, or other clear connection), the Organiser reserves the right to retain only the first valid entry and remove the others. 3.4. Participation in the Contest is entirely free of charge and is not linked to any purchase obligation. No purchase of products or services from the Organiser is required to participate or to win. Article 4 — Entry Procedure 4.1. To participate, the Participant must: upload one (1) photo that meets the content requirements set out in Article 5; provide their name and a valid email address; accept these Terms; confirm their email address via the confirmation link sent by email (double opt-in). 4.2. An entry is only valid and visible on the leaderboard once the email address has been confirmed. Unconfirmed entries are automatically deleted after 14 days. 4.3. After confirmation, the Participant receives a unique, personal entry link which they may freely share to collect votes. This link may only be used to fairly collect votes from third parties (see Article 6), not to generate automated, purchased, or acquired traffic. Article 5 — Photo Content & Usage Rights 5.1. The submitted photo must: have been taken by the Participant themselves, or the Participant must hold all necessary rights and permissions (including consent from any people depicted); not infringe on the rights of third parties (copyright, image rights, trademark rights, privacy); not contain offensive, discriminatory, violent, sexually suggestive, or otherwise inappropriate content; not depict persons who are clearly minors without unambiguous consent from a parent or guardian; not show full or partial nudity, including exposed breasts, nipples, buttocks, or genitals. This applies regardless of the age of the person depicted and regardless of the context, including artistic images, breastfeeding scenes, and photos of fully or partially nude children; comply with the specified technical format (JPG/PNG/HEIC/HEIF). 5.2. The Organiser reserves the right to reject or remove, without prior notice and without compensation, any entry that does not comply with these terms. 5.3. By submitting a photo, the Participant grants the Organiser a non-exclusive, free-of-charge right to display the photo on the leaderboard. The Participant retains all rights to their photo; this is not a transfer of ownership or exclusivity. In addition, the winner of the main prize agrees that their name and submitted photo may be used by the Organiser to announce the winner via the Organiser's marketing channels (including social media, website, and newsletters), unless the winner explicitly objects at the time the prize is awarded. Article 6 — Voting Procedure 6.1. Anyone (Participant or not) can vote on an entry by: opening the unique entry link; providing a valid email address; confirming the email address via the confirmation link (double opt-in). 6.2. A vote only counts once the email address is confirmed. Unconfirmed votes do not count. 6.3. A maximum of one (1) valid vote per email address per entry is allowed for the entire Contest Period. Multiple votes from the same email address, the same device, or the same IP address on the same entry may be considered fraud (see Article 8). 6.4. Voting is free of charge and not linked to any purchase obligation. Article 7 — Determining the Winner(s) and Prizes 7.1. The ranking is determined based on the number of valid, confirmed votes each entry has received at the end of the Contest Period (see Article 2). 7.2. Prizes: 1st place Sunweb travel voucher €1250 2nd place Stampix photo voucher €150 3rd place Stampix photo voucher €100 Top 100 Stampix Postcard €2.99 7.3. In the event of a tie between two or more entries for a prize-winning place, the entry with the earliest confirmed entry will be declared the winner. 7.4. The winner(s) will be contacted within 10 business days after the end of the Contest Period, via the email address provided at entry. If the winner does not respond within 5 days, the Organiser reserves the right to award the prize to the next entry in the ranking. 7.5. Prizes are not exchangeable for cash and are not transferable to third parties, except with the Organiser's prior written consent. 7.6. Use of the main prize (the Sunweb travel voucher) is subject to the Sponsor's (Sunweb's) own terms and conditions, including any validity period, booking conditions, and availability. The Sunweb voucher will be valid for flight holidays with departure from Brussels Airport and departures up to 31/10/2027. The voucher needs to be redeemed before the 31st of February 2027. These terms will be communicated by the Sponsor at the time the prize is issued. The Organiser has no influence over, and is not responsible for, the content, application, or execution of these terms. 7.7 Each Participant in the Top 100 with a valid, confirmed entry shall receive a free printed postcard of the photo, sent to the specified address, regardless of whether they win the Contest. Postcards will only be sent to countries available in the Stampix webshop in the postcard category. Article 8 — Exclusion and Fraud The Organiser reserves the right to exclude a Participant, an entry, or votes from the Contest, without prior notice and without any right to compensation, in the event of: the use of false identities, disposable email addresses, or automated/purchased votes; non-compliance with these Terms; conduct that jeopardises the fair conduct of the Contest (e.g. soliciting votes via paid advertising or bots, multiple accounts). The Organiser's decision on this matter is final. If fraud is established after a prize has been awarded, the Organiser may reclaim the prize and award it to the next eligible entry. Article 9 — Liability 9.1. The Organiser cannot be held liable for: technical issues (network, hosting, or server failures, data loss, misdirected or undelivered confirmation emails) affecting participation or voting; unavailability of the platform during (part of) the Contest Period; damage arising from participation in the Contest or the receipt/use of the prize, except in the case of intent or gross negligence. 9.2. The Sponsor cannot be held liable for the organisation of the Contest, and is only responsible for the delivery of the main prize in accordance with the Sponsor's own terms. 9.3. In the event of force majeure, the Organiser reserves the right to suspend, modify, or cancel the Contest without owing any compensation to Participants or Voters. Article 10 — Processing of Personal Data 10.1. For the processing of personal data in connection with this Contest, the Organiser (Stampix BV) is the data controller within the meaning of the General Data Protection Regulation (GDPR). 10.2. In connection with the Contest, we process: name, email address, the submitted photo, and any attached description/location (Participants); email address (Voters); and, where provided, technical data needed for fraud detection (e.g. timestamp of vote/entry). 10.3. This data is processed to: (a) verify and validate participation or a vote; (b) compile the ranking and determine and contact the winner; (c) detect and prevent fraud and misuse; (d) award and deliver the main prize, for which the necessary personal data of the main prize winner is shared with the Sponsor (Sunweb), who uses this data solely to deliver the prize; (e) where the Participant has explicitly opted in, to subsequently send marketing communications from the Organiser; and (f) where the Participant has separately and explicitly opted in, to share their name and email address with the Sponsor (Sunweb), so that the Sponsor may send marketing communications to the Participant. 10.4. Processing is based on the performance of these Terms (contract, art. 6.1.b GDPR) for (a) through (d), and on consent (art. 6.1.a GDPR) for (e) and (f). 10.4bis. Consent for (e) and (f) is separate: a Participant may choose to receive marketing communications from the Organiser only, from the Sponsor only, from both, or from neither. Declining this consent (these consents) has no effect on participation in the Contest. 10.5. Personal data and photos of Participants and Voters are retained for up to 6 months after the end of the Contest, except for data for which the Participant/Voter has explicitly consented to further use (marketing opt-in), which is retained until that consent is withdrawn. 10.6. To operate the platform, the Organiser relies on subcontractors (sub-processors), including for hosting/storage within the EU (including AWS — Dublin/Frankfurt; Neon — hosted in Frankfurt, with appropriate safeguards such as standard contractual clauses since the parent company is based outside the EU). 10.7. The Organiser applies appropriate technical and organisational measures, including encryption of data in transit and at rest, role-based access control, and an incident response procedure in the event of data breaches. 10.8. As a Participant or Voter, you have the right to access, rectify, erase, restrict the processing of, and port your data, and the right to withdraw your consent (for marketing) at any time. Article 11 — Complaints and Questions Complaints and questions about the Contest can be directed to support@stampix.com. Article 12 — Modification and Termination The Organiser reserves the right to modify, suspend, shorten, extend, or cancel these Terms or the Contest at any time, for organisational, technical, or legal reasons, without owing any compensation. Changes will be communicated via the contest page. Article 13 — Governing Law and Competent Court These Terms are governed by Belgian law. Any dispute arising from these Terms will be settled in accordance with the applicable statutory rules on jurisdiction, without prejudice to mandatory consumer protection rules that may entitle the Participant/Voter, as a consumer, to bring a dispute before the court of their own place of residence.
